Terms and Conditions
Terms & Conditions  ( The small print !)

As all the products Stephen makes are bespoke and made individually to special order we ask payment in full for orders under £350.00. Where the cost is above £350.00 I will require a deposit payment which will be agreed with individual clients.  The balance of outstanding  payments will be required prior to dispatch. All payments are fully acknowledged and receipted. If you choose to collect your dial any balances have to be paid and cleared before collection. If an order is cancelled after the commission has been confirmed and once work has begun we reserve the right to retain the deposit, in whole or part, as this will cover the cost of materials used specifically for your bespoke product. However, If the dial has not yet been completed a charge will be deducted from the deposit to cover time spent on the design work , materials used and administration, this may be equivalent to the full deposit but will not exceed the full amount already paid.


Work on your bespoke dial will not start until written confirmation/approval of dial engraving or sign writing details has been received and deposit/full payment cleared.




All of Stephen’s work is individually made to order (bespoke). The Distance selling and online trading, Customers rights to return goods and cancel services section of the “Distance Selling Regulations” does not therefore apply. There is no cooling off period on receipt of goods.  If you have not seen Stephen’s work in person at a show, you are more than welcome to visit me at my workshop - please call for details and to arrange an appointment before travelling.

Orders confirmed without viewing indicates your acceptance of standard and quality of work as shown within this site.

Goods may only be accepted for return/refund it they are proven to be of defective manufacture.  No returns will be accepted without written authority from Stephen Holehan Sundials.

No engraving/letter cutting will take place until written proof of approval has been received, alterations to engraving/letter cutting after they have been engraved will attract additional charges ( which may be the full product cost) if requested after acceptance has been given. Where dials require a declination reading this must have been taken by you the customer and the paperwork received by Stephen Holehan Sundials. Only at this point will estimated delivery time be given. Delivery estimates apply from the point that the customer has “signed off” the design work as ready for manufacture.  Stephen Holehan Sundials cannot guarantee to meet a specific date but will always endeavour to do so where this is feasibly possible. Any delays will be notified in writing/email.

Customers who have not seen Stephen’s work in person are free to arrange a visit to my workshop to view and assess my work, please do not do so without a mutually agreed appointment. Customers who have not seen my work in person accept it as sold unseen.

A detailed photograph or photographs will be sent of your completed sundial at the point of requesting final payment.  All payments are fully acknowledged and receipted. If an order is cancelled after you make the commission and once work has begun there will be no refund of the deposit as this will cover the cost of materials used specifically for your bespoke product. In placing and then confirming an order with Stephen Holehan Sundials you are agreeing to accept these conditions. Your statutory rights are unaffected. Overseas customers accept uk consumer law in placing an order.



Stephen Holehan Sundials - Privacy and GDPR Policy

Information we collect from you?
When making an order with Stephen Holehan Sundials;
When you contact us via the website via the email form or by manually entering our email address via your own email platform, write or telephone us:
We will collect your name, site installation location information, billing address, email and postal address and a contact telephone number, we may also collect geographical location data if the dial is a present for another person/location.
We use this to design and calculate your sundial, Allow processing of your payment and in case we need to contact you specifically about your order.
 We will use this information to contact you about your query. We will not use your email or physical address to send marketing communications.
Are your credit or debit card details kept on file by Stephen Holehan Sundials?
We do not keep any records of your credit/debit card details  in any form, either written, electronically or in a database. If you are paying via means of card payment we will use your name ,email address and physical address to initiate an electronic invoice via PayPal. Once you enter your details online via the PayPal portal, the transaction is processed via our payment processer and we do not have access to any payment details ourselves. It is the payees responsibility to take sensible measures to protect their own data when making electronic payments over the internet. Eg Using upto date anti virus and phishing protection on their own equipment.
When you pay for an order via a cheque we will record your name, sortcode and account number within our accounting system to comply with UK tax law. This information will never be willingly shared.
How will we use the information about you?
We collect and use information about you to process your order.
Stephen Holehan Sundials  use the services of third party software providers to provide our email services. As a result of this your contact information may be hosted on servers outside of the UK. We carefully check these services to ensure they comply with UK GDPR regulation.

Direct Marketing
We will not use your data to send direct marketing to you in the future unless you have specifically asked us to do so, nor will we ever sell or willingly allow your data to be used/accessed by others.
You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of your personal information, please email or write to us at the address below.

Use of images of the work we make for you.
We reserve the right to use images of the sundials we make for the purpose of advertising our business where they have been taken by ourselves during installation or sent to us by clients. , we will where requested digitally edit out location details, eg longitude/latitude information visible on the product or aspects of property that the client feels they do not want on show.
We want to make sure that your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate. In certain circumstances, you can request that we erase your data which we will do where this would not prevent us meeting our legal and regulatory obligations.

We may also disclose information if we have good reason to believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Agreement), including investigations of potential violations thereof; (iii) investigate, detect, prevent or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.


Cookies
We and our web hosting partners use cookies and other technologies in our related services, including when you visit our Site or access our services.

A "cookie" is a small piece of information that a website assigns to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. These purposes include allowing you to navigate between pages efficiently, enabling automatic activation of certain features, remembering your preferences and making the interaction between you and our Services quicker and easier. The Site uses the following types of cookies:

a. 'session cookies' , which are stored only temporarily during a browsing session in order to allow normal use of the system and are deleted from your device when the browser is closed;

b. 'persistent cookies', which are read only by the Site, saved on your computer for a fixed period and are not deleted when the browser is closed. Such cookies are used where we need to know who you are for repeat visits, for example to allow us to store your preferences for the next sign-in;

c. 'third-party cookies' , which are set by other online services who run content on the page you are viewing, for example by third-party analytics companies who monitor and analyse our web access.

Cookies do not contain any information that personally identifies you, but Personal Information that we store about you may be linked, by us, to the information stored in and obtained from cookies. You may remove the cookies by following the instructions of your device preferences; however, if you choose to disable cookies, some features of our Site may not operate properly and your online experience may be limited.

We use a tool which is based on the Snowplow Analytics technology to collect information about your use of the Site. The tool collects information such as how often users access the Site, which pages they visit when they do so, etc. The tool does not collect any Personal Information and is only used by our Site hosting and operating service provider to improve the Site and services.
Use of script libraries (Google Web Fonts)
In order to present our contents correctly and make them graphically appealing across all browsers, we use script libraries and font libraries such as Google Web Fonts (https://www.google.com/webfonts) on this website. Google Web Fonts are transferred to your browser's cache to avoid multiple loading. If your browser does not support Google Web Fonts or does not allow access, content will be displayed in a default font.

    Calling script libraries or font libraries automatically triggers a connection to the library operator. In theory, it is possible – but currently also unclear whether and, if so, for what purposes – that operators of corresponding libraries collect data.

Third-party collection of information
Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to.

This Privacy Policy does not apply to the practices of companies that we do not own or control, nor to individuals whom we do not employ or manage, including any of the third parties which we may disclose information to as set out in this Privacy Policy.
How do we safeguard your information?
We take great care in implementing and maintaining the security of the Site and your information. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorised access or abuse our Site or premises and we make no warranty, express, implied or otherwise, that we will prevent such access.
Transfer of data outside the EEA
Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.
Marketing
We do not engage in future marketing using your data.

Updates or amendments to this Privacy Policy
We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
